2. Eligibility & Use of Website

To use this website or make a purchase, you must be at least 18 years old and have the legal capacity to enter into contracts under applicable law. By using the website, you confirm that you meet these eligibility requirements.

You agree not to:

• Use the website for any unlawful or prohibited purpose.
• Impersonate any person or misrepresent your identity.
• Violate any laws, including but not limited to intellectual property rights.

We reserve the right to refuse service, cancel orders, or terminate accounts if we suspect that a user is violating these Terms or engaging in illegal activities.

Prévaut GmbH offers a range of high-quality luxury jewelry products, including leather bracelets, cuffs, rings, and pendants made from 18-carat yellow gold, white gold, and rose gold, with some featuring diamonds. Our products are crafted with precision by skilled artisans in Europe.

Accuracy of Descriptions: While we make every effort to ensure product descriptions, images, and specifications are accurate, slight variations may occur due to differences in screen displays. These variations do not constitute defects.

All products are subject to availability. Prévaut GmbH reserves the right to modify or discontinue any product at any time without prior notice. We will notify you if an item is unavailable after an order has been placed, and you may choose an alternative or receive a refund.

4. Pricing, Taxes & Payment

Pricing:
All prices listed on the Prévaut GmbH website are in Euros unless explicitly stated otherwise. Prices displayed at the time of your order will be the prices applied to your purchase. Prévaut GmbH reserves the right to modify prices at any time, without prior notice, in response to market fluctuations, operational costs, and other influencing factors. However, any changes in price will not affect an order that has already been confirmed by us.

Inclusive of Taxes:

Our prices include any applicable Value Added Tax (VAT) and other relevant sales taxes for orders placed within the European Union. For customers outside the European Union, VAT may not apply; however, any other applicable duties, taxes, or fees required by your country of residence may be imposed upon delivery. These charges are beyond the control of Prévaut GmbH, and the customer is solely responsible for paying such fees upon receipt of the shipment unless otherwise specified.

Shipping Costs:

Prévaut GmbH offers free shipping for all orders delivered to the United States, European Union, and the United Kingdom. Free shipping includes standard delivery service with our designated carrier and full insurance coverage during transit. Expedited or premium delivery options may be available at an additional cost, and these charges will be disclosed at the time of checkout.

Payment Methods:

We accept a variety of secure payment methods, ensuring our customers have flexibility in completing their transactions. The available options include:

• Credit Cards (Visa, MasterCard, American Express): Processed securely via Shopify Payments.
• PayPal: For those who prefer a digital wallet or direct bank integration.
• Apple Pay and Google Pay: Streamlined mobile payment services for quick and easy checkout.
• Klarna: For customers seeking installment-based payment options, subject to Klarna’s terms and approval processes.

Payment Security:

All payments made on the Prévaut GmbH website are encrypted and processed securely using Shopify Payments. Your financial information, including credit card details, is never stored on our servers. By submitting your payment information, you authorize Prévaut GmbH to process the charges using your selected payment method.

Failure of Payment:
If your payment method is declined or fails to authorize, Prévaut GmbH reserves the right to cancel your order. You will be notified of such cancellation, and you may attempt to resolve the issue by contacting your payment provider or choosing a different method of payment.

5. Order Process & Acceptance

Placing an Order:
Once you have selected the products you wish to purchase, you may proceed to the checkout page where you will be prompted to review your order and provide your payment information. After completing the checkout process and submitting your payment, you will receive an order confirmation email. However, please note that this confirmation email does not constitute acceptance of your order. It is merely an acknowledgment that your order has been received by us.

Order Acceptance & Contract Formation:
A legally binding contract between you and Prévaut GmbH is only formed once we have dispatched your products and sent you a shipping confirmation email. We reserve the right to refuse or cancel any order at our discretion before dispatch, even after the order confirmation has been sent. Circumstances that may result in order cancellation include, but are not limited to:

• Unavailability of stock.
• Payment authorization issues.
• Inaccuracies in product or pricing information.
• Suspicion of fraudulent or illegal activity.

If your order is canceled after payment has been processed, Prévaut GmbH will issue a full refund using the original payment method. Please note that depending on your financial institution, refunds may take several business days to reflect in your account.

Order Modifications:
If you wish to modify your order after it has been placed, please contact us at info@prevaut.com as soon as possible. While we strive to accommodate requests for changes, we cannot guarantee that modifications can be made once an order has been processed or shipped.

Pre-Orders & Custom Products:
In certain cases, Prévaut GmbH may offer pre-orders or custom-made products. For such items, specific timelines for production and delivery will be communicated at the time of purchase. Custom products are generally non-refundable and non-returnable, unless they are found to be defective or damaged upon receipt.

6. Shipping, Delivery & Insurance

Shipping Destinations:
Prévaut GmbH offers worldwide shipping with a focus on the United States, European Union, and the United Kingdom. We are proud to offer free shipping to these regions, and our international shipping capabilities allow us to serve customers in additional locations as well. If you are located outside these regions, please contact us at info@prevaut.com to confirm whether shipping is available to your country.

Shipping Providers & Options:
Our primary shipping provider is FedEx and DHL Express, a trusted global courier known for reliable service. Once your order is processed and ready for dispatch, we will send you a tracking number via email so that you can monitor the status of your shipment.

Estimated Delivery Times:

• United States: 1-3 business days.
• European Union: 1-3 business days.
• United Kingdom: 1-3 business days.

Please note that these delivery times are estimates and may be subject to delays caused by factors outside our control, such as customs inspections, weather conditions, or carrier-related issues. While we make every effort to ensure timely delivery, Prévaut GmbH cannot be held responsible for unforeseen shipping delays.

Customs & Import Duties:
For international orders, including shipments to countries outside the European Union, customs clearance may be required. Prévaut GmbH will cover all applicable customs duties and taxes to ensure a smooth delivery process. If any additional documentation or information is required by customs authorities, you may be contacted directly by the shipping carrier.

Shipping Insurance:
All shipments sent by Prévaut GmbH are fully insured against damage or loss during transit. The insurance coverage begins when the package is handed over to the shipping carrier and continues until the package is delivered to the designated shipping address. If your package is lost or damaged during shipment, please notify us immediately at info@prevaut.com so that we may initiate an insurance claim and arrange for a replacement or refund.

Risk of Loss:
Once the package has been delivered to the specified address, the responsibility for any loss or damage passes to you. It is your responsibility to ensure that the shipping address provided at checkout is accurate and secure.

7. Returns, Refunds & Cancellations

7.1 Return Period

You may return eligible products within 30 days of delivery. Contact info@prevaut.com with your order number and reason for return. We will provide return authorization and prepaid shipping instructions.

All returns are subject to inspection. Items that do not meet the conditions in Section 7.2 will be rejected and returned to you at your expense.

7.2 Return Conditions

To qualify for return, the product must meet all of the following:

• Unworn, unused, and in original condition as delivered
• Original packaging intact (boxes, pouches, protective materials)
• All certificates, documentation, and accessories included and undamaged
• No signs of wear, scratches, modifications, or damage

7.3 Non-Returnable Items

The following are final sale and cannot be returned:

• Customized, personalized, or engraved products
• Made-to-order items crafted to your specifications (custom sizing, bespoke designs, non-standard materials)
• Items showing any evidence of wear or alteration after delivery

Exception: Defective products may be returned regardless of customization (see Section 7.6).

7.4 Return Shipping

After receiving authorization:

1. Ship the item within 14 days using the instructions provided
2. Package securely to prevent damage in transit
3. Use trackable, insured shipping (recommended)

You are responsible for the item until we receive and inspect it. Items received more than 45 days after delivery will not be accepted.

7.5 Refunds

After successful inspection, we will refund your original payment method within 14 business days.

Refund includes:

• Full purchase price and taxes paid
• Original shipping fees only if the return is due to our error (defect, wrong item shipped)

Allow 5-10 additional business days for your payment provider to process the refund.

7.6 Defective or Incorrect Items

If your item arrives defective, damaged, or incorrect, contact info@prevaut.com within 7 days of delivery. Include:

• Order number
• Description of the issue
• Clear photographs

We will provide one of the following at no cost to you:

• Full refund (including original shipping)
• Repair
• Replacement

We will provide a prepaid return label for defective or incorrect items.

This reporting timeline ensures eligibility for transit insurance claims and does not affect your coverage under our Lifetime Craftsmanship Warranty for latent manufacturing defects.

7.7 Cancellations

Orders may be cancelled within 24 hours of placement if production has not started. Contact info@prevaut.com immediately.

Once production begins (typically within 24-48 hours for made-to-order items), orders cannot be cancelled. You may return the item upon delivery per Sections 7.1-7.2.

7.8 Exchanges

We do not offer direct exchanges. To obtain a different size or product:

1. Return your item following Section 7.4
2. Request a refund
3. Place a new order for the desired product

Exchanges are not guaranteed due to product availability.

7.9 Gift Returns

Orders placed November 1 - December 24 may be returned through January 31 of the following year. All other return conditions apply.

7.10 Additional Terms

• We reserve the right to refuse returns for policy abuse (repeated returns, returning worn items, fraudulent claims)
• This policy may be updated at any time. The version in effect at purchase applies to that transaction
• This policy does not affect your statutory consumer rights under applicable law

 

8. Craftsmanship Warranty

8.1 Warranty Coverage

Prévaut GmbH offers a lifetime craftsmanship warranty from the date of delivery for all jewelry products. This warranty covers manufacturing defects and workmanship failures that occur under normal use.

Covered defects include:

• Manufacturing defects (hallmark errors, purity discrepancies, structural flaws)
• Workmanship failures (clasp malfunction, finish deterioration under normal use, joint separation)
• Functional defects (cuff mechanisms that fail to open or close properly, excessive tarnishing not attributable to customer use)

8.2 Warranty Exclusions

This warranty does not cover:

• Normal wear and tear (surface scratches, patina development on brushed finishes, minor color changes over time)
• Damage resulting from accidents, misuse, abuse, or improper care (including but not limited to dropping, bending, chemical exposure, or impact damage)
• Alterations, modifications, or repairs performed by third parties not authorized by Prévaut GmbH
• Lost or stolen items
• Products showing evidence of wear or use inconsistent with the claimed defect

8.3 Warranty Claim Process

To initiate a warranty claim, you must contact info@prevaut.com and provide:

• Your order number
• Date of delivery
• Detailed description of the defect or failure
• Clear, high-resolution photographs showing the issue from multiple angles

Prévaut GmbH will assess your claim after receiving all required information. If we determine that the claim falls within warranty coverage, we will provide you with a prepaid return shipping label and instructions for returning the item.

Upon receipt and inspection of the returned item:

• If the warranty claim is validated, Prévaut GmbH will repair, replace, or refund the item at our sole discretion
• Resolution will be completed within 14 business days of receiving the returned item
• If the claim is determined to be outside warranty coverage, we will contact you with an explanation and options, which may include returning the item to you or providing a paid repair quote

8.4 Warranty Limitations

This warranty is:

• Non-transferable and applies only to the original purchaser
• Valid only for products purchased directly from Prévaut GmbH through www.prevaut.com or authorized retailers
• Subject to verification through proof of purchase (order confirmation, invoice, or receipt)
• Limited to repair, replacement, or refund of the defective product; Prévaut GmbH is not liable for any consequential, incidental, or indirect damages

Geographic coverage: This warranty applies worldwide to all regions where Prévaut GmbH ships products.

9. User Accounts

Creating a user account on our website is optional. However, if you choose to create an account, you are responsible for maintaining the confidentiality of your account and password. Prévaut GmbH will not be held liable for any unauthorized use of your account.

If you suspect that your account has been compromised, you must notify us immediately at info@prevaut.com. We reserve the right to suspend or terminate accounts if we detect unauthorized activity or misuse.

10. Intellectual Property

All content available on the website www.prevaut.com, including but not limited to text, designs, logos, photographs, images, graphics, icons, video clips, and software, is the intellectual property of Prévaut GmbH or our licensors. This content is protected by applicable copyright, trademark, and intellectual property laws.

You are granted a limited, revocable, non-transferable, and non-exclusive license to access and make personal use of the website and its contents. This license does not include the following:

• The resale or commercial use of the website’s content.
• The collection or use of product listings, descriptions, or prices for commercial purposes.

Prévaut GmbH does not warrant or guarantee the accuracy, reliability, or functionality of these third-party tools, nor do we accept any liability for issues arising from their use.

While we make every effort to partner with reliable third-party service providers, Prévaut GmbH shall not be held liable for any damages, delays, or failures caused by the third-party tools or services you use on our website. This includes issues related to:

• Payment processing errors or delays caused by third-party platforms.
• Shipping delays or damages incurred during delivery handled by third-party carriers.
• Data breaches or security issues related to third-party platforms.

Customer Liability:
You are solely responsible for ensuring that your use of third-party tools and services complies with the terms and conditions set by those third parties. Our total liability for any claim related to a product purchase shall not exceed the amount paid for the product.
